Visas are granted conditionally to children born with foreigners residing in Korea as their parents.

We implement conditional relief measures for illegally staying children born in Korea as attached.

However, if it is always implemented for all children born in Korea, there is a high concern about side effects such as an increase in the influx of illegal immigration by the family by means of children. To operate.

1. Application period: From April 19, 2021 to February 28, 2025

2. Remedy target

○ ’21. 2. 28. Those who have previously graduated from elementary school and meet all of the following requirements at the time of application

① Born in Korea ② Stayed in Korea for more than 15 years ③ Enrolled in middle or high school or graduated from high school in Korea as of the date of application

○ ’21. 2. 28. Those who graduated from elementary school before and did not meet the qualification requirements at the time of the implementation date of the system, but the implementation period of ’25. 2. Those who have satisfied all the above 3 requirements by 28. and who apply within that period

3. Actions on children

○ Measures

– Children and parents visit the competent Immigration and Foreigners Office (office) to apply

-The immigration and foreigners’ offices (offices) submit the application, conduct an actual condition survey, etc., put the conditions for compliance* on the child and grant the status of residence.

  • Compliance conditions: Compliance with law and order, maintenance of a sincere academic life, etc.

– Granting status of residence (D-4) for study until graduation from high school

Or If you have graduated from high school as of the application date

-If you meet the requirements for study abroad or employment, change to the status of residence

– If you do not meet the requirements for changing your status of residence for studying abroad or working, grant or change your status of residence to a temporary status of residence (G-1) for one year

-In accordance with the Immigration Control Act, cancellation of the status of residence or extension of the period of stay is not permitted.

4. Measures against the child’s parents (illegal immigrants)

○ Measures

– Departure is a rule, but for the rearing of underage children , temporary stay in Korea is allowed until an illegally staying child graduates from high school or becomes an adult.

Imposition of penalties for parental violations

– When applying for relief for children, a notice of the planned penalty imposition is issued to the parent of the child, and the penalty for illegal stay of the parent and the reduction amount for each payment period*, etc.

* Depending on the time of payment, 30% ~ 100% of the original offense amount

-If the parent pays the penalty , measures such as granting a temporary residence status (G-1) until the child graduates from high school and permission to engage in activities other than the status of residence for raising the child.

Or Temporary stay permit and departure measures

-When a child graduates from high school or reaches adulthood, he/she must leave the country on his own, and if he/she stays illegally without leaving the country, departure measures and restrictions on re-entry

5. How to apply

Child and parent (guardian) visit and apply at the competent immigration/foreignment office (office) (parents cannot apply separately from children)

※ The child’s address is the standard of jurisdiction, excluding branch offices.

6. Required documents

Required documents

– Integrated application for granting the status of residence for children (“Enforcement Regulations of the Immigration Control Act”, Attached Form No. 34 Integrated Application) and detailed description ([Attachment 1] form)

– Child and parent passport

– Documents proving the child’s birth in Korea (birth certificate or official document of the home country),

– Certificate of enrollment or graduation certificate from elementary, middle and high school ※ If the real name is different from the name recorded on the certificate of enrollment or graduation, submit a certificate issued with the real name verified by passport, etc.

– If the child’s passport name is different from the Korean name (real life use or school registration name), a document that can confirm the Korean name ※ Past enrollment (graduation) certificate with the Korean name, family letter, and other documents that can confirm the name must be submitted. , Indicate the Korean name on the application form

– Documents proving the place of stay (rental contract, etc.)
